Please read these terms and conditions of Use
(hereinafter referred as “Terms of Usage”) carefully as they describe and
govern your use of the content and services offered by astrogyanbindu,
including all our website “www.astrogyanbindu.com”(“Site”), mobile application and
software applications (“App”) operated
by ACADSI PVT. LTD. Reference to “we”,
“us” and “our” refer to ACADSI PVT. LTD
and “you” and “your” refers to the user.
UPDATION
The Site or App
may be updated, modified, or amended at any time by us. It is the User's
responsibility to review the Terms of Usage on a regular basis to make sure
they are still being followed.
USER CONSENT
By accessing the App or Site and using it,
indicates that you understand the terms and unconditionally & expressly
consent to the Terms of Usage Please do not click the
"I AGREE" button if you do not agree to the Terms of Usage. Before
using or registering on the App or Site, or before accessing any content, information,
or services through the Site, the user is recommended to carefully read the Terms of
Usage. Your use and continued usage of the App or Site (irrespective of the amendments made from
time to time) shall signify your acceptance of the terms of usage and your
agreement to be legally bound by the same.
GENERAL DESCRIPTION
The App is an software application designed
for both desktop and mobile devices having its existence on Play Store and App
Store, while the Webite is a portal accessible over the
Internet that is present on the World
Wide Web, applications and
other electronic medium. They offers astrological material,
statistics, reports, data, telephone,
video and email consultations (hereinafter referred as “Content”). The subscription
offers both “Free Services” and “Paid Services” (Collectively referred as
“Services”). While it is possible to use free services without becoming a
member whereas, for accessing the personalized astrological services and/or
receive additional Content you need to sign up for Paid Services. For both
services you need to sign in to the App or
Site.
By opting for Paid Services, a member agrees:
- To provide current, complete, and accurate information
about himself/ herself as prompted on the portal.
- To maintain and update the information as required and
submitted by you keeping in view
the accuracy and privacy
of the information being current and complete.
REGISTRATION AND ELIGIBILITY
- The User of the App or the Site must be a person that have legally binding contracts under
Indian Contract Act, 1872. A juvenile under the age of eighteen (18) in
most jurisdiction, are not permitted to avail the services provided on the
App/ site without a legal guardian in accordance with the
applicable laws. We
disclaims all liability from any misuse that might result by
virtue of any person including a minor using the services provided through
the App/
Site.
- To
get the benefits and to avail the services, the User will be directed to Register
as a Member on the Site/ App whereby he/ she agrees to provide latest, and accurate information when filling up and
submitting the
sign-in form. The particulars furnished on the App or the Site and all updates thereto are referred
to in these Terms of Usage as "Registration Data."
- The
User have the option of creating an
account by
using their phone number as the
Website ID and generating the password
via OTP. While making an account, the user
represents and guarantees that all of the information they have given is
true, correct, and complete, and that they will continue to maintain this
accuracy and periodically update it. It is strictly forbidden to use
another User's account details to access the services. The Website has the
right to suspend or cancel the User's account and restrict or deny the
User's future use of the Website/ App if it is discovered that
the information they have provided is false, incomplete, outdated, or
inaccurate.
- The User alone is the
owner and has the right to use this App/ Site; no other person or organization may
acquire this right. Passwords and other information needed for
registration must be kept private, and that responsibility falls on the
user. All actions taken using the User's account on the Website are
entirely the User's responsibility. If the User fails to maintain
confidentiality and secrecy, the Website cannot and will not be liable for
any loss or damage. If the User discovers any unauthorized use of their
account(s) or security breach, they must contact the Website right away.
After the session, the User must log out of their account.
- When
utilizing any service, the User
will be informed whether the service provided is exclusive
to the Site or offered
by a Third party. The Site shall have no authority or oversight
on the information disseminated to any third party via the Site.
- The user acknowledges
and agrees that the App/ Site and/or payment
service provider(s) have no control over the misuse, hacking, theft, or
fraud of personal information, including but not limited to information
about debit and credit card numbers, that is transmitted over the
Internet.
- The Website does not permit the use of the Services by
any User under the following conditions: -
- If the User is a residing
at any place where the use of the services
provided by the Website is illegal.
- If the User is a resident of
any State/Country that prohibits by way of law, regulation, treaty or
administrative act for entering into trade relations or/and
- Owing to any religious practice/ custom.
- If the User has used
multiple mobile numbers to
create
different accounts. It is
not permissible to the
User to have more than one active account with the Site/ App.
FEATURE “CALL WITH ASTROLOGER”
The App and Site offer certain services that may be accessed by medium of
telecommunication with the enrolled and listed astrologers on
the Website. Even though your mobile number is on DND service according to your
mobile service provider, accepting the current Terms of Usage also gives us your unqualified approval to call you on that number.
WEBSITE/ APPLICATION CONTENT
- The Site
and App which may be available through external hyperlinks
with the Website are its
private property.
- These Terms of Usage
apply to all interactions on this App or
Site, including advice and guidance
obtained directly from the Licensed Provider.
- The User is not permitted to post or transmit
any content via this website that violates or infringes upon the rights of
others, or that is illegal, abusive, defamatory, invading someone's privacy,
vulgar, obscene, profane, or otherwise objectionable, or that encourages
behavior that would be grounds for criminal prosecution, give rise to
civil liability, or violate any other law.
- The Site and
App shall have a right to suspend
or terminate any permission of
such User or terminate the User’s registration and such User shall not
gain access to the Site/ App.
- The Site and
App has the right to discontinue the access or to amend or terminate any
aspect or feature of the Site or App
including, but not limited to, content, graphics, deals, offers, settings,
etc.
- Medical advice should
not be derived from any information on the site, including but not limited
to guidance and advice obtained directly from Third-Party Service
Providers, educational materials, research sources, graphics, and other
incidental information.
- The Site and App makes no guarantees about the medical
advice given by third-party service providers, including astrologers who
have registered with the site. Always seek the advice of a suitably
skilled healthcare provider for a diagnosis and treatment plan, including information
on which prescription drugs or other treatments could be suitable for the
user. Nothing in the Content suggests or guarantees that a certain drug or
course of treatment is suitable, safe, or successful for you. Astrological
Voice does not recommend any particular diagnostic tools, drugs, supplies,
or methods.
- The Site and App disclaims any liability for any unfavorable event that may arise
with the User after following
their use
of the Service. Accessing
the Site or App in such situation
is solely at the user’s risk. Neither the Site and App nor the Service Provider offering the
advise are liable or guarantee any outcomes as envisaged by the User.
- By using the Site, Application or Services, you hereby agrees that any legal remedy or liability that
you seek to obtain for actions or omissions of other Members inclusive of
the service provider registered with the Website or other third parties
linked with the Website, shall be limited to claim against such particular
party who may have caused any harm. You agree not to attempt to impose
liability on or seek any legal remedy from the Website with respect to
such actions or omissions.
USER ACCOUNT ACCESS
To ensure and maintain the high-quality
services offered by the Website and to effectively handle consumer needs, the
Website will have access to the account and information generated by the User.
The user hereby permits the Site or App, its staff, agents, and any other designated
individual in this regard, unrestricted access to their account. The Website
will look into each instance individually using the records at hand in order to
resolve any complaints (if any) and any reports of suspected abuse. The User is
advised to review the conditions listed in the Privacy Policy with reference to
these records.
